• NMIRF 180°: Now Asks To Move Superior Court Case to Federal Court

After more than 3 years in Superior Court and after fighting at least 2 outside legal attempts to have the case moved to Federal Court the NMIRF has done a 180° turn and now is requesting that the case be removed to Federal Court.

The Marianas Variety ran this article today: http://mvariety.com/cnmi/cnmi-news/local/46768-fund-wants-lawsuit-removed-from-govendo.php

Most recently, in late 2011, Sapuro Rayphand had asked to move the Superior Court case to Federal Court. This move was met with resistance by the NMIRF, who filed a motion to Remand the case back to Superior Court.

We should be able to safely assume that should the Chapter 11 Bankruptcy proceedings be thrown out of Federal Court the NMIRF attorneys will no longer fight against moving the case to Federal Court through receivership or other means.

The more I read today the more I worry about the management of our RF.
They are so self assured when they make stupid moves and remarks and so humble when the adults laugh at them.
Lets’ face it. The Federal Court has adults in charge. NMI – who do we have in charge?
To an outside observer NMI has little children in charge. Will they learn, can they learn? Ask the Commissioner of Education. PSS had been dealing with this specific issue for years. I think we are at the 33rd percentile about now. I will not try to translate that for you, but PSS makes presentations yearly. It is enough to say that NMI has a long way to go. PSS works very hard to accomplish its mission.
I think before this humiliating episode in NMI History (yes, this is recorded history) is over, there will be something like education going on.
If NMI is really lucky a Federal Judge will appoint a Governor for the NMI until it can be straightened up a bit.
Let’s pray we get really lucky!
